Wills & Estate Lawyer Morayfield

You don't need a house to need a will. You need one the day you have a child, a super balance, or someone who'd be lost without instructions.

Morayfield is the most rented locality in the Caboolture district — 43.9% of households at the 2021 Census, against just 19.7% owned outright — which is exactly why so many local families assume a will isn't worth doing yet. It is. Superannuation, life insurance, a car, and everything else you own still has to go somewhere, and if you have children under 18 your will is the only place you get to name who raises them. A wills and estate lawyer Morayfield families can see without taking a day off work — book a free, no-obligation first consultation and find out what your will actually needs to cover.

The opening line we hear most often from Morayfield clients is I don't own much, so this should be quick. It rarely is, and that's a good thing. Close to a quarter of Morayfield families are one-parent families (24.1%), which puts the guardianship clause — not the asset list — at the centre of the appointment. Superannuation and life insurance frequently add up to more than the car and the contents of the house combined, and neither follows your will automatically unless your nominations say so too. Blended and re-partnered households are common here as well, which raises a separate question about who can later make a claim against the estate. We start every Morayfield appointment with what you actually have and who depends on you, then build the will drafting around that.

Common Problems & Solutions

"I rent and don't own much — people say I don't need a will."

CausePeople equate a will with dividing property, so a no-property estate feels like it doesn't need one.

Our solutionWe explain that guardianship, super and insurance direction are often the real reasons a Morayfield renter needs a will, and draft around exactly that.

"My ex is still named as beneficiary or executor from before we split."

CauseSeparation doesn't automatically revoke a will or update a nomination the way marriage does — the old instruction just sits there.

Our solutionWe review and update the will and the related nominations together, so neither is quietly out of step with your current life.

"My super nomination has never actually been checked."

CauseNominations are set once, when a fund account is opened, and most people never revisit them.

Our solutionWe check the current nomination against the will at the same appointment, since the fund pays under its own records, not the will.

Local Area Insights: Morayfield

Local context

Morayfield is the largest locality in the Caboolture district and the most tenant-heavy: 43.9% rented, only 19.7% owned outright, median household income $1,442 a week. The workforce leans manual — 16.5% trades, 16.3% labourers — with health care, retail and construction the three biggest employers.

Common challenges

None of that shows up on a title search, because for a lot of Morayfield estates there isn't one. What there is instead: a super balance with a nomination nobody has looked at since it was set up, a life insurance policy tied to a job that may have changed, a car, tools, a bank account. Super sits outside your estate by default and isn't automatically directed by your will — it surprises almost every client we mention it to.

Why it matters

Renting also means people move, and a resident who rents today may have named an executor or beneficiary who has since gone interstate or lost touch. That doesn't invalidate the will, but it makes it slower and more expensive to act on, right when the family needs it to work smoothly.

Our approach

We run every Morayfield appointment in the same order: dependants and guardianship first, the assets that sit outside the will second, the will itself last. It's the sequence most online will kits skip entirely.

Morayfield, and How to Reach Us

Morayfield sits immediately south of Caboolture in the City of Moreton Bay, named after the Morayfield estate first established there in the 1850s. It was farmland on the Caboolture River flats for most of its history until rail and later the Bruce Highway pulled it into Brisbane's northern commuter belt. From the 1990s, growth around the Morayfield Shopping Centre and the Morayfield Road corridor made it the largest residential locality in the district — almost 25,000 people today, median age 34, with housing shifting steadily from detached blocks toward townhouses over the past two decades.

Why Morayfield Families Choose Catton Roderick

Our office sits on East Street in Caboolture, a straight run down Morayfield Road — close enough to sign your will on a lunch break, which matters when 41.9% of the local workforce is in trades, machine operation or labouring and leave isn't always negotiable. Every wills matter is handled personally by the firm's principal, Dr Darren Catton, who holds a Doctorate of Juridical Science from QUT, carries the TEP designation for specialist trust and estate practitioners, and sits on the Queensland Law Society's Property Law committee. The firm states he has practised in Queensland estate law for more than 30 years. A straightforward Morayfield will still gets that solicitor, not a template.

  • Your estate gets a proper appointment, house or no house. Superannuation nominations, life insurance, guardianship and personal effects are all worked through — none of it skipped because there's no property title.
  • Nothing starts until you've heard the price. The first meeting is free and confidential; the full fee is quoted before any drafting begins.
  • Guardianship is the centrepiece, not a checkbox. We help you name a guardian and a backup, and talk through how your children are actually provided for.
  • Your executor gets it in writing. Not a verbal briefing they half-remember later — a written record of what the role involves.
  • One number reaches all three offices. Caboolture, Redcliffe and Birtinya all answer on 1300 209 997.

Questions

Frequently asked questions

Morayfield Wills: Questions We're Asked Most

I rent and don't own much. Do I actually need a will?

Yes — often more urgently than someone who owns property. Without one, your estate follows the fixed order set out in the Succession Act 1981 (Qld), starting with a spouse and children, regardless of who you'd have chosen. And if you have children under 18, the will is the only place you get to name their guardian. Renting changes the size of an estate, not whether it exists.

Does my will cover superannuation and life insurance?

Not automatically. Super generally isn't an estate asset — it's directed by the nomination you've made with your fund, which may well be out of date. Life insurance held inside super follows the same rule. This is general information, not financial advice, but it's why we always check your nominations before drafting.

I'm a single parent — what happens to my kids if something happens to me?

Your will appoints their guardian, and we recommend naming a backup in case your first choice can't act. We also talk through how any inheritance is provided — held until a set age rather than paid out at 18, for instance — and who manages it until then. It's usually the longest part of a Morayfield appointment, and the most important.

Can I just use an online will kit?

You can, but section 10 of the Succession Act 1981 (Qld) sets strict signing formalities — your signature made or acknowledged in front of two witnesses present together, who then sign in front of you. Kit wills fail these requirements often, and fixing it afterwards through the courts costs far more than the will would have.

What does a will actually cost?

It depends on the estate. The first consultation is free and confidential, and we quote the full fee before any work starts, so there's no open-ended bill. Simple wills sit at the lower end; blended families or business interests take more time. Ask us to confirm current pricing when you call.

My ex has re-partnered. Can they claim against my estate?

Under section 41 of the Succession Act 1981 (Qld), a spouse, child or dependant can apply to the court for provision if they weren't adequately provided for. Eligibility depends on their circumstances at the date of death, and an application generally has to start within nine months of the death, though the court has some discretion to allow a late one. We can help you plan around the risk — we can't promise a particular outcome.
