Wills & Estate Lawyer Burpengary East

The children have grown up, the mortgage is nearly gone, and the will you wrote for a young family doesn't fit the household you have now.

Burpengary East has the highest rate of outright home ownership in the district — 36.8% at the 2021 Census, well ahead of its neighbours — and couples without children (43.6%) now edge out couples with children (43.2%) as the largest household type. It's a settled, established suburb where the life stage has quietly moved on: the will written when the kids were young may still name a guardian for children who are now adults, or leave everything in a way that no longer matches what you actually own. A wills and estate lawyer Burpengary East residents come back to for exactly this review — the first conversation is free.

The Burpengary East conversation is rarely about starting from nothing — it's about a will that's fallen behind a household that's changed. Guardianship clauses written for primary-school-aged children are meaningless once those children are adults; a mortgage the will assumed would still be running may now be paid off, changing what's actually in the estate; and with couples-without-children now the largest single group, more Burpengary East wills need to address what happens if a couple has no children at all — where intestacy law behaves very differently to a family with kids. We treat a review appointment with the same care as a first will, because for most Burpengary East clients that's effectively what it is.

Common Problems & Solutions

"Our will still names a guardian for kids who are now adults."

CauseGuardianship clauses are rarely revisited once children reach adulthood, even as the rest of the family's circumstances keep changing.

Our solutionWe treat an outdated guardianship clause as a prompt for a full review, since the executor and distribution are often out of date too.

"We don't have children — who inherits under our old will?"

CauseWithout children, a will does all the work that a spouse and children would otherwise do automatically under intestacy — so an old or vague will carries more weight, not less.

Our solutionWe draft the will to name exactly who inherits, including provision for a simultaneous-death scenario, so nothing is left to the statutory default.

"Our mortgage is finally paid off — does that change anything?"

CauseAn unmortgaged home is a cleaner asset than one with debt attached, but the will may still be written as if the loan were running, which can muddy a distribution.

Our solutionWe revisit the distribution strategy now that the property is a clean asset, particularly if it's being left to more than one person.

Local context

Burpengary East is the newer, more settled half of the Burpengary district — 9,654 residents, median age 38, with mortgaged (41.1%) and rented (18.8%) both among the lowest shares in the group, and housing almost entirely detached (92.3%).

Common challenges

High outright ownership, an even split between family types, and a moderate-to-older median age point to a locality where households have largely finished the asset-building phase and are now in the "review, not build" stage of estate planning. A will drafted a decade ago for a young couple with a mortgage and small children doesn't describe most Burpengary East households anymore.

Why it matters

The guardian named may be irrelevant, the executor may no longer be the most practical choice, and where a couple never had children, the will is doing all the work that a spouse and children would otherwise do automatically under the intestacy rules — meaning it has to be right, because there's no statutory fallback that reflects a childless couple's actual wishes.

Our approach

A Burpengary East appointment starts by asking what's changed since the last will was signed, then works through guardianship, executors and beneficiaries in that order — updating only what needs it.

We check an existing will against your current household — grown children, a changed asset picture, a different executor in mind — and redraft what no longer fits rather than starting over unnecessarily.

Estate planning for established, largely unmortgaged estates

With outright ownership the norm here, distribution strategy is often more straightforward — but naming beneficiaries clearly still matters, especially between adult children or where there are none.

Executor selection, with written guidance

An executor named when children were young may no longer be the right choice once they're adults. We help you reconsider, then set the role out in writing.

Why Burpengary East Residents Choose Catton Roderick

Our East Street office in Caboolture is a short, easy drive from anywhere in Burpengary East, and appointments are scheduled properly rather than squeezed in — useful when 36.8% of local households own their home outright and have the flexibility to come in during the week. The work is handled personally by the firm's principal, Dr Darren Catton — an SJD from QUT, the TEP designation for specialist trust and estate practitioners, a seat on the Queensland Law Society's Property Law committee, and, on the firm's account, more than 30 years practising Queensland estate law.

  • Reviews taken as seriously as first wills. Guardianship clauses, executor appointments and asset lists are checked against your household as it stands today, not as it stood a decade ago.
  • Childless-couple estates covered properly. Where there are no children, we make sure the will — not the intestacy rules — decides who actually inherits.
  • Free, confidential first consultation, full fee quoted before any drafting starts.
  • Written guidance for your executor, updated to reflect who's actually best placed to act now.
  • Secure storage of the signed original, with a copy for your own records.

Questions

Frequently asked questions

Burpengary East Wills: Common Questions

My will still names a guardian for my kids, but they're adults now. Does that matter?

An outdated guardianship clause doesn't invalidate the rest of your will, but it's a clear sign the document hasn't been reviewed in a while, and other parts — the executor, how assets are distributed — are often out of date too. It's worth treating as a prompt for a full review, not just deleting one clause.

We don't have children. Who inherits if we don't have a will?

Under the Succession Act 1981 (Qld), if there's a surviving spouse and no children, the spouse generally takes the whole estate. Without a spouse or children, the estate passes outward to parents, then siblings, then nieces and nephews — which may be very different from who you'd actually choose. A will lets you decide this directly.

Our mortgage is paid off. Does that change what we need in our will?

It changes what your estate is actually worth and how straightforward dividing it can be — an unmortgaged house is a cleaner asset to leave than one with debt attached. It's a good reason to revisit distribution strategy, particularly if you're leaving the property to more than one person.

How often should we actually review our will?

Whenever a major life event happens — children reaching adulthood, a mortgage being paid off, a change in health, a business starting or ending — or at minimum every five years even if nothing obvious has changed. Burpengary East's settled, established households are exactly the profile most likely to have a will that's technically valid but practically out of date.

Can we just update the names on our existing will ourselves?

No — a will can only be altered through a formal codicil or a new will, executed with the same signing formalities as the original under section 10 of the Succession Act 1981 (Qld). Handwritten changes on an existing document are generally not effective and can create real doubt about what you intended.

What does a will review cost compared to a new will?

Often less, since much of the groundwork is already there, but it depends on how much has actually changed. We quote the full fee up front after a free, confidential first consultation — ask us to confirm current pricing when you call.
