Wills & Estate Lawyer Bellmere

Young kids and a mortgage make this the will that matters most — and usually the one nobody's got round to.

Nearly a quarter of Bellmere's residents are children under 15 (24.1%, equal-highest in the district), and 34.4% of households are paying off a mortgage. That combination gives a will a very specific job: name who raises your children, decide the age at which they inherit, and make sure the mortgage, life insurance and superannuation don't leave your family holding a house they can't keep. As a wills and estate lawyer Bellmere parents rely on, this is the conversation we have most weeks — and the first one is free.

Bellmere is a young-family locality — median age 34, couple families with children the largest household type at 39.1% — and most people who call us here are making a first will, not revisiting one. The sticking points are always the same three: deciding on a guardian means a conversation with your own family that nobody enjoys; leaving everything to a partner seems obvious until you consider both of you being in the same car; and handing an 18-year-old a lump sum is rarely what anyone actually intends. A wills and estate lawyer earns their keep here by making those three decisions concrete instead of theoretical — guardians first, then how and when children inherit, then the drafting itself.

Common Problems & Solutions

"We haven't agreed on a guardian — it feels like an impossible conversation."

CauseNaming a guardian means having a direct conversation about mortality, and about family members, that most couples keep putting off.

Our solutionWe help you work through the decision with a practical lens — who's genuinely able and willing — and recommend speaking to that person before naming them.

"Our mortgage would be a disaster if one of us died."

CauseLife insurance taken out when the loan started rarely scales automatically with a larger mortgage or growing family.

Our solutionWe check whether current cover and super would actually clear or service the loan, and flag the gap plainly if there is one.

"We don't want our kids getting a lump sum at 18."

CauseA standard will often pays an inheritance outright at 18, which for life insurance and super can mean a far larger sum than anyone intended handing to a new adult.

Our solutionWe draft the will to hold a child's share in trust and release it in stages, or at an age you choose, with someone you trust managing it until then.

Local context

Bellmere sits north-west of the Caboolture town centre — 6,588 residents across largely newer detached housing (88.1% separate houses, almost no apartments). Age is its defining feature: median 34, with couple families with children leading at 39.1%. The workforce is trade-heavy — labourers 15.4%, trades 14.6%.

Common challenges

Estates like these are young, leveraged, and dependent on income continuing. The house is usually the only significant asset, and it's mortgaged, so it can't simply be "left to the children" — someone has to be able to service or discharge the loan. Life insurance and super often exceed everything else in the estate combined, and neither is directed by the will automatically.

Why it matters

Where the children are genuinely young, an outright gift just means a bank transfer landing on their eighteenth birthday. Bellmere's car dependence adds a practical wrinkle too: with most local traffic on Bellmere Road, both parents being in the same vehicle at the same time is a real scenario — which is exactly why the substitute guardian and substitute executor clauses aren't filler.

Our approach

A Bellmere appointment starts with the children and works outward: guardian, substitute guardian, the age at which they inherit, who manages it until then — and only after that, how the house and the insurance fit around those decisions.

Bellmere, and How to Reach Us

Bellmere lies north-west of Caboolture in the City of Moreton Bay, between the Caboolture River and the farmland running out toward Wamuran. It was dairy and small-crop country through most of the twentieth century, and the name survives from the rural holdings that once covered the area. Residential subdivision arrived later than in Caboolture itself — Bellmere's growth belongs largely to the 1990s onward, which is why the housing stock is newer and the population younger than the older parts of the district. Today it's a settled commuter locality of around 6,600 people, still bounded by farmland on its western edge.

Why Bellmere Families Choose Catton Roderick

Bellmere is the most car-dependent locality in the district — 67.0% of workers drive themselves, the highest of the six, with only 7.4% working from home — so appointments are built around that reality. Our Caboolture office is a short run down Bellmere Road, and we schedule so you're not stuck in a waiting room while the school pick-up window closes. The drafting itself is handled personally by the firm's principal, Dr Darren Catton — an SJD from QUT, the TEP designation for specialist trust and estate practitioners, a seat on the Queensland Law Society's Property Law committee, and, on the firm's account, more than 30 years practising Queensland estate law. Catton Roderick is locally owned and operated.

  • Guardianship done properly. Primary and substitute guardian, plus a frank conversation about whether your first choice can genuinely take it on.
  • Inheritance staged, not dropped at 18. A child's share can be held in trust and released in stages, or at an age you choose, with someone you trust managing it until then.
  • Mortgage and insurance checked against the will. With 34.4% of Bellmere households mortgaged, we make sure your policies and nominations agree with what the will says.
  • Free, confidential first consultation, full cost quoted before any drafting starts.
  • Written guidance for your executor, so they know the job before they ever have to do it.

Questions

Frequently asked questions

Bellmere Wills: Questions from Local Families

Who raises our children if something happens to both of us?

Whoever you name as guardian in your will — leave it unnamed, and it becomes a question others have to resolve, potentially through the courts, at the worst possible time. We recommend naming a primary guardian and a substitute, and encourage clients to actually ask those people first. It's the reason most Bellmere parents finally get a will done.

Can I stop my kids inheriting everything at 18?

Yes. A will can hold a child's share in trust and release it at an age you choose, or in stages, with a trustee managing it in the meantime. For younger families this often matters more than the size of the estate, since life insurance and super can make a modest estate suddenly substantial.

We still owe money on the house. Does that change our wills?

It changes the planning around them. A mortgaged property passes with its debt attached, so the real question is whether the person inheriting could service or discharge the loan — often via life insurance. With 34.4% of Bellmere households mortgaged, this comes up constantly, and we check that the will and your insurance and super nominations point the same way.

Do we each need our own will?

Yes — a will is an individual document; there's no joint will in Queensland practice. Couples usually make mirror wills leaving everything to each other first, then to the children, with matched guardian and executor appointments. We prepare them together in one appointment, generally faster and cheaper than doing them separately.

What if we never get around to it?

Then the Succession Act 1981 (Qld) decides, under a fixed statutory order starting with a spouse and children — which may not match what you'd have chosen, and says nothing at all about guardianship. Given how many Bellmere households are young families with dependent children, that gap is the real cost of putting it off.

How long does it take, and what do we need to bring?

Most straightforward Bellmere wills are drafted after one appointment, reviewed with you, then signed at a short second visit. Bring a rough list of assets and debts including the mortgage, your super fund and any nominations, life insurance details, and the full names of your proposed guardians and executors. Having already discussed the guardian question saves the most time.
