Wills & Estate Lawyer Clontarf

No single housing story fits Clontarf, so no single will should either.

Clontarf is the rare locality where no housing tenure dominates — 30.1% own outright, 33.4% are still paying off a mortgage, and 33.7% rent, an almost even three-way split at the 2021 Census. Add a median age of 46 and 21.0% one-parent families, and you have a suburb where a template will drafted for "the typical homeowner" simply doesn't fit most people. A wills and estate lawyer Clontarf residents can rely on starts by working out which of those three situations is actually yours, then drafts around it. The first conversation is free.

Most estate planning templates quietly assume a homeowner with a spouse and kids. In Clontarf that assumption is wrong more often than it's right: a third of households are renting, couples without children (43.1%) outnumber couples with children (35.1%), and one-parent families sit above the district average. That means the standard advice — "leave the house to the kids" — doesn't apply to a third of the suburb, and "leave everything to your spouse" doesn't cover the many childless couples and single parents living here. We ask what you actually have and who actually depends on you before we draft anything.

Common Problems & Solutions

"We're renting — does a will even apply to us?"

CauseMost will templates are written around property division, so a no-property estate feels like it falls outside what a will is for.

Our solutionWe draft around superannuation, insurance and personal effects — and guardianship if you have children — rather than assuming a house title.

"Our mortgage is paid off, but our will still assumes we owe money."

CauseOnce a mortgage is discharged, a property becomes a larger, more straightforward asset than the will may have anticipated when it was drafted.

Our solutionWe revisit the distribution strategy now that the property is unencumbered, particularly where it's being left to more than one person.

"We're a childless couple — who inherits by default?"

CauseWithout children, the Succession Act 1981 (Qld) decides for you if there's no will — a spouse first, then outward to parents, siblings and nieces and nephews.

Our solutionWe draft the will to name exactly who inherits, including provision for a simultaneous-death scenario, so nothing defaults to the statutory order.

Local context

At 8,446 residents, Clontarf sits on the western side of the Redcliffe peninsula, median age 46. Its defining feature is the absence of a dominant housing story: outright ownership, mortgages and renting are all within a few points of each other, the most balanced tenure split of any locality we cover.

Common challenges

That balance means Clontarf wills genuinely can't be templated. A renter needs a will that covers superannuation, insurance and personal effects rather than a house title. An outright owner needs distribution strategy for a paid-off property. Someone still paying a mortgage needs the will and the insurance to actually cover the debt.

Why it matters

With one-parent families above average, guardianship carries real weight for a meaningful share of the suburb — and a will drafted for "the typical homeowner" leaves that group, and the many childless couples here, without the provisions that actually matter to them.

Our approach

We start every Clontarf appointment by identifying which of these situations is actually yours, then build the guardianship, distribution and executor clauses around it.

Clontarf, and How to Reach Us

Clontarf sits on the western shore of the Redcliffe peninsula, in the City of Moreton Bay, overlooking Bramble Bay. It's one of the peninsula's older settled suburbs, developed steadily through the twentieth century rather than in a single building boom, which is part of why its housing stock — and its population — is genuinely mixed rather than uniform. Today it's home to 8,446 people with a median age of 46, and a locality where owners, mortgagees and renters live side by side in roughly equal numbers.

Questions

Frequently asked questions

Clontarf Wills: Questions We're Asked Most

I rent — do I still need a will?

Yes. Superannuation, life insurance, vehicles and personal effects all still need a will to direct them, and if you have children under 18, a will is the only place you name their guardian. Renting changes what's in your estate, not whether you need one.

My house is paid off — is my will still up to date?

Not necessarily. Once a mortgage is discharged the property becomes a larger, more valuable asset than the will may have anticipated, which is a good reason to revisit how it's divided, especially between more than one beneficiary.

I'm a single parent in Clontarf — what's the most important clause in my will?

Naming a guardian and a substitute guardian. We also work through how any inheritance is provided for your children — held until a set age rather than paid out at 18 — and who manages it until then.

We're a couple with no children. Who inherits if we don't have a will?

Under the Succession Act 1981 (Qld), a surviving spouse generally takes the whole estate where there are no children. Without a surviving spouse or children, the estate passes to parents, then siblings, then nieces and nephews — often not who you'd choose. A will lets you decide this directly.

What does a will cost?

It depends on your circumstances. The first consultation is free and confidential, and we quote the full fee before any work starts. Ask us to confirm current pricing when you call.
