Wills & Estate Lawyer Margate

You're renting, you're past 45, and you may be starting again. That's a different will to the one most templates assume.

Margate has the highest rental rate on the peninsula — 40.9% of households at the 2021 Census — paired with the highest share of one-parent families, 24.5%, and a median age of 46. That's not the profile of a young renter flat-sharing before a first home; it's often someone renting later in life, frequently after a separation, sometimes raising children alone. A wills and estate lawyer Margate residents work with builds a will around that reality — superannuation, guardianship and who's actually in the picture — rather than assuming a house and a settled couple. The first conversation is free.

Renting later in life usually means an estate built from superannuation, insurance, savings and personal effects rather than property — assets that are easy to overlook and, in super's case, not automatically controlled by a will at all. Combine that with Margate's high one-parent family share and the guardianship clause carries real weight for a meaningful share of local clients. We ask about both — what you own and who depends on you — before drafting anything.

Common Problems & Solutions

"I'm over 45 and renting — people assume I don't need a will yet."

CauseA will is often associated with property, so renting later in life gets mistaken for a reason to put it off.

Our solutionWe draft around superannuation, insurance and personal effects — the real substance of the estate — and guardianship if children are involved.

"I'm a single parent — what's my most urgent decision?"

CauseWithout a second parent in the picture, a guardianship clause carries more weight than in a two-parent household, but it's easy to put off.

Our solutionWe treat naming a guardian and a substitute as the centrepiece of the appointment, alongside how any inheritance is held until children are older.

"My super nomination has never been checked against my will."

CauseSuper sits outside the estate and follows the fund's own nomination, which is rarely reviewed once set.

Our solutionWe check your current nomination as part of every Margate appointment, not just the will itself.

Local context

Margate sits between Woody Point and Clontarf on the peninsula's western shore — 7,575 residents, median age 46. Its tenure profile stands apart, with 40.9% rented against 27.9% owned outright and 28.8% mortgaged.

Common challenges

That combination of high rental and high one-parent-family shares, at an older-than-average median age, points to a specific group: people who are renting not as a stepping stone to ownership but as an ongoing arrangement, often following separation or a change in family structure later in life.

Why it matters

For this group, a will needs to work hard on two fronts most templates ignore — directing assets that sit outside a house (super, insurance, savings) and naming a guardian and provisions for children where there's no second parent automatically in the picture.

Our approach

We ask about both before drafting anything: what you own, independent of property, and who depends on you, so neither gets treated as an afterthought.

Like much of the older peninsula it has a long-established, ageing housing stock, with rental accommodation making up a larger share of the market than anywhere else on the peninsula — a legacy of its mix of older units and share housing alongside family homes. Questions

Frequently asked questions

Margate Wills: Common Questions

I rent and I'm over 45. Isn't a will mostly for homeowners?

No — a will directs superannuation nominations, life insurance, savings and personal effects regardless of whether you own property, and if you have children under 18, it's the only place you name their guardian. Renting changes what's in your estate, not whether you need a will.

I'm a single parent. What's the most important part of my will?

Naming a guardian and a substitute guardian. We also talk through how any inheritance is provided — held until a set age rather than paid at 18 — and who manages it in the meantime. It's usually the longest part of a Margate appointment.

My ex-partner has re-partnered. Can they claim against my estate?

Potentially, depending on timing and circumstances. Under section 41 of the Succession Act 1981 (Qld), a spouse, child or dependant may apply to the court for provision, generally within nine months of the death. We can help you plan around this risk.

Does my will cover my superannuation?

Not automatically. Super generally sits outside your estate and is directed by the nomination held with your fund, which may be outdated or absent. We check your nominations as part of every Margate appointment, not just the will itself.

What does a will cost?

It depends on your circumstances. The first consultation is free and confidential, and we quote the full fee before any work starts. Ask us to confirm current pricing when you call.
