Wills & Estate Lawyer Burpengary

Separation, a new partner, a blended household — Burpengary has more of them than anywhere else in the district, and old wills don't update themselves.

Burpengary carries the highest share of one-parent families in the Caboolture district — 19.0% at the 2021 Census, against a firmly mixed backdrop of 42.3% couple families with children and 37.7% without. It's the district's largest and longest-established locality, and that maturity shows up as blended families, second relationships and wills that were signed for a household that no longer exists. A wills and estate lawyer Burpengary families return to after a separation or a remarriage exists for exactly this — updating who inherits, who's guardian, and who acts, before the paperwork falls further out of step with real life. The first conversation is free.

Most people who come to us from Burpengary aren't making a first will — they're trying to fix one that's gone stale. A marriage in Queensland automatically revokes an earlier will unless it was made in contemplation of that marriage; separation and divorce don't revoke it the same way, which is the trap that catches people out. An ex-partner named as executor or beneficiary can, in some circumstances, remain in place until the will is actually changed. With close to one Burpengary family in five now a one-parent family, and a further sizeable share re-partnered, that gap between "what the will says" and "who's actually in the picture" is the single most common reason people call us from this suburb.

Common Problems & Solutions

"I separated but we're not divorced — is my ex still entitled?"

CauseUnlike marriage, separation on its own doesn't revoke a will under Queensland law, so an ex-partner can remain a named beneficiary or executor until it's actively changed.

Our solutionWe treat an update after separation as urgent, not optional, and redraft the will to reflect your household as it actually stands now.

"I remarried and never made a new will."

CauseMarriage automatically revokes an earlier will under the Succession Act 1981 (Qld) unless it was made in contemplation of that specific marriage — many people simply don't know this.

Our solutionWe draft a new will so you're not unknowingly relying on the intestacy rules instead of any will at all.

"My stepkids aren't mentioned in my will at all."

CauseA stepchild isn't automatically treated the same as a biological or adopted child for inheritance purposes, so a will has to say so explicitly to provide for them.

Our solutionWe identify every child in the household by relationship and name provision for each one specifically, rather than leaving it assumed.

Local Area Insights: Burpengary

  • 19.0%one-parent families — highest in the districtSource: ABS 2021 Census
  • 16,488residents — largest, most established localitySource: ABS 2021 Census
  • 36median ageSource: ABS 2021 Census

Local context

At 16,488 residents, Burpengary is the largest and most established locality in the district. Housing is a genuine mix rather than dominated by one tenure — 41.0% mortgaged, 30.5% rented, 26.3% owned outright — and the family-type split tells the real story: 42.3% couple families with children, 37.7% couples without, and 19.0% one-parent families, the highest of any locality covered on this site.

Common challenges

That family-type mix is what makes Burpengary wills different from a newer, more uniform suburb. A one-fifth share of one-parent families means a correspondingly large number of blended or re-partnered households, and blended households are exactly where an out-of-date will causes the most damage — a former partner still named, a stepchild not provided for, a guardian nomination that no longer reflects who's actually raising the children day to day.

Why it matters

Marriage revokes an earlier will automatically in Queensland unless it was made with that marriage in mind; separation on its own generally does not revoke anything, which is precisely the gap that catches Burpengary families out.

Our approach

A Burpengary appointment starts by mapping the household as it stands today — current partner, all children, whoever is actually the guardian in practice — before touching a single clause of the existing will.

Burpengary, and How to Reach Us

Burpengary sits south of Caboolture in the City of Moreton Bay, on the North Coast railway line that shaped its growth from an 1880s timber and dairying settlement into the district's transport and retail hub. The station and the Burpengary Road shopping strip give it a genuine town centre that its newer neighbouring suburbs don't have, and decades of continuous growth have produced the mixed, multi-generational population the Census shows today — 16,488 people, a real spread of family types, and housing tenure split fairly evenly between owners, mortgagees and renters.

Why Burpengary Families Choose Catton Roderick

Burpengary is the district's transport hub — the railway station anchors a genuine town centre, and our East Street office in Caboolture is one stop up the line, an easy trip whether you drive or take the train. Every wills matter is handled personally by the firm's principal, Dr Darren Catton, who holds a Doctorate of Juridical Science from QUT, carries the TEP designation for specialist trust and estate practitioners, and sits on the Queensland Law Society's Property Law committee. The firm states he has practised Queensland estate law for more than 30 years.

  • Wills reviewed after separation or remarriage, properly. We check what a marriage automatically revokes, what a separation doesn't, and what still needs an active change.
  • Blended-family guardianship handled with care. Naming a guardian and provisions for children from more than one relationship is worked through in detail, not glossed over.
  • Full fee quoted before we start, after a free, confidential first consultation.
  • Written executor guidance so whoever you appoint understands the role, including where a former partner's claim might sit.
  • One number for all three offices — Caboolture, Redcliffe and Birtinya, on 1300 209 997.

Questions

Frequently asked questions

Burpengary Wills: Questions We're Asked Most

I've separated but we're not divorced yet. Is my old will still valid?

Usually, yes — which is the problem. Unlike marriage, separation on its own doesn't revoke a will under Queensland law, so an ex-partner can remain a named beneficiary or executor until you actively change it. If you've separated, treat updating your will as urgent, not optional.

I've remarried. Does my new marriage cancel my old will?

Generally, yes — under the Succession Act 1981 (Qld), marriage automatically revokes an earlier will unless it was made in contemplation of that specific marriage. If you married without making a new will, you may now be relying on the intestacy rules rather than any will at all.

How do I provide for stepchildren I haven't formally adopted?

A stepchild isn't automatically treated the same as a biological or adopted child for inheritance purposes, so if you want to provide for them, your will needs to say so explicitly. It's one of the most common oversights we find in older Burpengary wills.

Can my ex-partner still claim against my estate after we've separated?

Potentially, depending on timing and circumstances. Under section 41 of the Succession Act 1981 (Qld), a spouse, child or dependant may apply to the court for provision, and "spouse" can include a former de facto partner in some situations. An application generally has to start within nine months of the death. We can help you plan around this risk — we can't remove it entirely.

Who should I appoint as guardian in a blended family?

There's no automatic answer — it depends on who is actually raising the children and whether that's your current partner, a former partner, or someone else entirely. We talk through the practical reality of your household, not just who "should" be named on paper.

What does updating an existing will cost?

Often less than starting from scratch, but it depends on how much has changed. The first consultation is free, and we quote the full fee before any work begins. Ask us to confirm current pricing when you call.
