Wills & Estate Lawyer Currimundi

Currimundi's trades, care workers and mid-career families are often caught between a mortgage still running and a will that pre-dates the life they're actually living now.

Mid-life households are often the most under-planned, and Currimundi — 6,570 residents, median age 45, roughly even between couples with children (39.1%) and without (42.4%) — is a mid-life suburb through and through. A wills and estate lawyer Currimundi households turn to needs to check three things most other lawyers skip: whether the mortgage is actually covered, whether the will still matches the family, and whether a second relationship has been properly provided for.

Why Mid-Life Wills Have the Most Moving Parts

The mortgage may be half paid, the children may be teenagers or adults, and the will may pre-date a second marriage or a new job. For care-sector and trades workers, employer cover and super may be the largest protection in the household, and both sit outside the will. We review those together so the family isn't left with a mortgage and an out-of-date document at the point it matters most.

Common Problems & Solutions

"We're halfway through the mortgage — do we need a new will?"

CauseWills are usually set and forgotten, even as the loan, the children and the household's circumstances keep changing underneath them.

Our solutionA mid-life review checks the will against the loan and the insurance, which is the point where most problems actually show up.

"I've remarried — what happens to my first family?"

CauseMarriage revokes an earlier will unless it was made in contemplation of that marriage, a rule many people simply don't know about.

Our solutionWe draft a new will that provides clearly for both households, including any children from the earlier relationship.

"Our adult children should share the executor role — is that workable?"

CauseCo-executors need to agree on every decision, and that can stall an estate if siblings don't see eye to eye.

Our solutionWe usually recommend naming one lead executor and a substitute, with written guidance on how decisions are actually made.

Local context

Currimundi sits on the coastal strip between Minyama and Mooloolaba, and grew through the late twentieth century as a mix of established family homes and newer infill — 6,570 residents, with trades (16.9%) and community and personal service workers (14.8%) leading the local workforce.

Common challenges

A household in the middle of its working life usually carries the most moving parts of any life stage: a loan with years left to run, children at different stages of independence, and — not uncommonly — a will drafted before a separation or a new relationship.

Why it matters

Marriage revokes an earlier will in Queensland unless it was made in contemplation of that marriage, which catches people out more often than you'd expect. A will that pre-dates a second relationship may leave a new partner, or children from an earlier one, without the provision either of you intended.

Our approach

We treat a Currimundi appointment as a review against the loan, the children and any change in relationship status — then draft only what's actually changed, rather than starting from nothing.

Questions

Frequently asked questions

Currimundi Wills: Common Questions

We're halfway through the mortgage. Do we need a new will?

Probably, if the will pre-dates the children growing up, a second relationship or a change of executor. A mid-life review checks the will against the loan and the insurance, which is the point where most problems show up.

My employer cover ends when I change jobs. What should I do?

Check whether personal cover is also in place, and record the cover and its end date in your planning. We include that in the review so the will doesn't assume protection that may have lapsed.

I've remarried. What happens to my first family?

Marriage revokes an earlier will unless it was made in contemplation of that marriage. Your new will needs to provide for both households clearly, including any children from the earlier relationship.

Our adult children should share the executor role. Is that workable?

It can be, but co-executors need to agree on decisions. We usually recommend naming one lead executor and a substitute, with guidance on how decisions are made.

What does a will cost?

It depends on the estate. The first consultation is free, and the full fee is quoted before work starts.
