Transfer of Property Between Spouses

Most people are not aware that a transfer of principal place of residence between spouses (married or de facto) is generally free of transfer duty.
Certain documents have to be lodged with the Office of State Revenue however the process will normally only cost a few hundred dollars and not the few thousand dollars that most people imagine.
The issue of transferring property to a new spouse normally arises when there is a third party likely to make a claim against the estate of one of the spouses. For example, a husband transfers half of her home to her second husband to protect the property from any claim that the children of her first marriage may have against that property on her death.
